Mediated Partnership Disputes and Term Negotiations in the Construction Industry

Our client hired us after having been to countless lawyers to help determine a way forward for the two founding partners who were in dispute on partnership terms.

The Situation

Our client had a construction company that had really grown and was doing close to $1M in annual revenue. When the company was small the partners got along fine, but as it grew they started feeling disgruntled towards each other and wanted to renegotiate terms. The one partner was temporarily out of the country and the other was running all day-to-day operations; however, both were extremely dedicated and adding significant value.

Our Process

We worked close with the partners on individual points and explained when one is or is not being fair to make the process smoother; ultimately becoming the objective party that allowed them to operate the business and move forward.

We listened carefully to both sides and most importantly spent time figuring out what would be best for the business itself. After understanding each person's interests and levels of flexibility we carved out a few innovative options to see initial reactions. We then worked closer with them on individual points and often explaining when one is or is not being fair to make the process smoother; ultimately becoming the objective party that allowed them to operate and move forward.

The Results

After a few iterations of the proposal we were happy to have guided the team to reach an agreement that was not able to have been reached with other mediators and lawyers. While we also helped guide them to continue business operations, it did take an inevitable hit, but shortly after the agreement was in place started building back up in a stronger than ever manner.
